Terms of Service

1. Acceptance of Terms

By accessing or using the Dialer.CX platform and services ("Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Services.

2. Description of Services

Dialer.CX provides a cloud-based call center platform including predictive dialing, AI voice bots, call recording, analytics, and related telecommunications services. Services are provided on a subscription basis as described in your service agreement.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree to use our Services in compliance with all applicable laws, including but not limited to the Telephone Consumer Protection Act (TCPA), Telemarketing Sales Rule (TSR), Fair Debt Collection Practices Act (FDCPA), and all state and federal Do Not Call regulations.

You shall not use our Services for any unlawful, harassing, or fraudulent purpose. Dialer.CX reserves the right to suspend or terminate accounts that violate these terms.

5. Billing and Payment

Subscription fees are billed monthly or annually as selected. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days' notice.

6. Data and Privacy

Your use of the Services is also governed by our Privacy Policy. You retain ownership of all data you upload to or generate through the platform.

7. Service Level Agreement

Dialer.CX commits to 99.99% platform uptime for Enterprise customers. Specific SLA terms are detailed in your service agreement. Service credits may be issued for qualifying downtime events.

8. Limitation of Liability

To the maximum extent permitted by law, Dialer.CX shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

9. Termination

Either party may terminate the subscription with 30 days' written notice. Upon termination, you may export your data within 30 days. After that period, data may be permanently deleted.
